1. General:

A. In using the website and/or platform at the address https://www.baraknadlan.co.il/ (hereinafter: "the platform," "the website"), the surfer, visitor, and/or user (in any manner whatsoever), or anyone on their behalf (hereinafter: the "user"), expresses their consent to these terms of use. The user declares that they have read and fully understood these terms.

B. The website and/or platform are operated by Barak Hass Holdings Ltd. (hereinafter: "the company") and present services offered and provided by it, not solely through the website.

C. The purpose of the platform is to provide information regarding the services offered by it, information about customers, etc.

1. Business Liability:

A. We make every effort to ensure that the content, services, and/or any other materials and content offered and displayed on the platform, whether by us or by third parties, are accurate.

B. The company and/or anyone on its behalf do not commit to the quality and/or accuracy and/or type and/or quantity and/or frequency of content, and it will have sole discretion for any change without notice and/or user update. The user waives any claim in this regard, including if any defect and/or discrepancy is discovered. Users can contact us for any matter, and we will do our best to assist the customer/user as soon as possible.

1. User Obligations Regarding Platform Use:

A. The user declares that they are aware that the use of the platform and the content presented therein will be in accordance with the company's instructions and according to the details in this agreement, as well as updates and instructions communicated to them from time to time.

B. The platform is designed to provide information and options to the user.

C. The content presented on the platform does not constitute a recommendation for financing and/or investment or sale/purchase of properties. The information is general and is not intended to replace the user's independent judgment and obtaining personal professional advice. It is recommended to consult personally with a certified investment advisor and/or authorized real estate intermediary and/or any relevant professional before any transaction.

D. The user hereby declares that they are aware that the use of information and/or investment and/or financing made in connection with the platform is done at their personal discretion, after comprehensive evaluation, and naturally always involves investment risks.

E. The platform, its owners, employees, managers, and/or anyone on their behalf shall not be liable for the accuracy of the information, content, form, accuracy of the data, and/or any direct or indirect loss, damage, or harm incurred by the user and/or any third party as a result of using the content and/or performing any investment related to the platform.

F. The user takes full responsibility upon themselves and waives any claims against the platform, its managers, employees, and/or anyone on their behalf in this matter, and commits to indemnify them with an immediate demand for any expenses and/or damages caused to them in this matter.

In addition to the above, use of the platform constitutes agreement:

A. Not to upload and/or send through the platform and/or future platforms any content that is illegal or that involves a violation of any law, including deceptive material, assistance, encouragement, infringement of intellectual property rights, defamation.

B. Not to upload, manage, or share content that violates privacy or breaches privacy in any way, including sending spam within this context.

C. Not to copy from the platform, and/or any entity or body associated with the platform, content and/or products, and not to use the published content for any purpose other than personal use.

Intellectual Property:

A. The user/surfer declares that they are aware that all intellectual property rights, including those embedded in the platform and/or cooperation with the company and/or anyone on its behalf, and the service, including images, diagrams, drawings, illustrations, presentations, icons, text, data, content, copyrights, trademarks, logos, patents, graphic symbols, models, trade secrets, fundamental ideas, are the exclusive property of Barak Has Holdings Ltd. and/or its owner. Any unauthorized use by the user/surfer or any third party is prohibited, constitutes a violation of rights, and requires specific written authorization or license from the company as determined from time to time.

B. The user declares that they are aware that all information, data, images, content, details, and/or any other material submitted by them to the platform and/or related or future platforms are owned by them or licensed by them. They are solely responsible for these and they declare that they have the right to do so with respect to intellectual property rights in the content and/or images or as a whole. This is not the responsibility of the company and/or its management and/or its owners, and the user is solely and fully responsible for ensuring that they do not infringe any rights. The user commits to indemnify and compensate the company, its officers, owners, managers, and/or anyone on its behalf, immediately upon first demand, for any damage or expense incurred as a result.

C. The user declares that in using the platform and/or the content displayed therein and/or related and/or associated platforms, they waive in advance any claim by them or anyone on their behalf to rights of any kind and nature, to consideration and/or remuneration from the company, its owner, management, employees, and/or anyone on its behalf.

Responsibility and Compensation:

A. As detailed above, the platform and/or any related platform, content, or information, are provided as is, and all use and application thereof are the sole responsibility of the user.

B. The user and/or surfer assume full responsibility for examining all offers and/or information on the platform and/or related platforms, including but not limited to offers for financing, projects, sales, purchases, endorsements, urban renewal, real estate, and anything related to them, whether directly or indirectly. They release the company, its owners, management, and employees from any liability, including damage of any kind.

C. Users declare that they are aware that when using the platform and/or any related platform, they may be exposed to advertisements, including business offers, general advertisements, benefits, discounts, and business proposals. The company is entitled to add and modify these advertisements and/or business offers as it sees fit, and the user waives any claim against the company in this regard. The company is not responsible for the accuracy of the information, advertisements, business offers, etc. provided by third parties and/or the company, and it is the user's responsibility to verify and validate this data.

D. In any case, the user and/or surfer and/or anyone on their behalf release the company, its management, owners, employees, and/or anyone on its behalf from any direct or indirect liability for any damage that may be caused or has been caused as a result of any use of the platform and/or any related platform, whether directly or indirectly.

E. The user undertakes to indemnify and compensate the company, its owners, and management and/or anyone on its behalf, immediately upon their first demand, for any damage incurred in connection with the use of any platform and/or any related platform, whether directly or indirectly, and in relation to a third party's claim against the company, its owners, management, employees, or anyone on its behalf, contrary to any law and/or contrary to the provisions of this agreement.

 

Privacy:

A. The company undertakes, through reasonable means available to it, to preserve the privacy of users and/or surfers on the platform and/or related platforms. This information will be kept by the company and/or on its behalf for its needs.

B. In the event that despite the security measures taken by the company, a third party breaches the secure and protected information in its possession and/or uses it for harm or otherwise, the user will have no claim, lawsuit, or demand against the company and/or its management, owners, employees, and/or anyone on its behalf.

C. The company reserves the right to collect relevant data for its purposes, such as users' use of the platform, including names, viewed pages, fields of interest, service development and improvement. The company may provide statistical and other data to third parties, provided that the data does not refer to personal or identifiable customers.

D. The company or anyone on its behalf reserves the right to contact the user in writing or otherwise with any information regarding service improvements, projects, content, tips, promotions, offers, products, new topics, etc.

In this regard, the use of the platform and/or any related platform constitutes consent to section 30A(b) of the Communication (Bezeq and Services) Law, 1982, and allows the company and/or anyone on its behalf to send users content, updates, benefits, and advertisements. The surfer and/or user waives in advance any claim or lawsuit against the company and/or the website in connection with "spam" and/or "spam" and undertakes to contact the company through accepted means for any issue or complaint in this regard.

 

General:

A. The company and/or its owners shall have the right to assign their rights and/or obligations under this agreement to any third party, without any notice to advertisers, users, surfers, or anyone on their behalf.

B. All information appearing on the platform, including in this agreement, including but not limited to service projects, advertisements, and anything related to the services offered therein, is subject to changes from time to time, without prior notice to users. This is at the exclusive discretion of the company and/or its owners.

D. The authorized court in the city of Tel Aviv-Jaffa (State of Israel) shall have exclusive jurisdiction over any dispute relating to the use of the platform and/or related platforms, and/or relating to this agreement.
